TERMS&CONDITIONS

1.0. Scope of Work

OAK&CROWN agrees to provide landscape design, garden installation, planting, and related services as outlined in the approved estimate, proposal, or contract. Any additional work requested outside the agreed scope may result in additional charges.

1.1. Plant &Tree Responsibility

All plants, trees, shrubs, sod, and other living materials become the sole responsibility of the client immediately upon installation and project completion.

OAK&CROWN is not responsible for:

  • Improper watering or lack of watering

  • Overwatering or under watering

  • Soil conditions beyond our control

  • Pet damage

  • Weather conditions including frost, drought, excessive rain, wind, or extreme temperatures

  • Pest infestations or plant diseases

  • Damage caused by wildlife

  • Neglect or improper maintenance by the client or third parties

The long-term health and survival of all plant material depends on proper ongoing care and maintenance by the client.

1.2. No Plant Warranty

Due to the living nature of plant material, cost, and environmental conditions beyond our control, OAK&CROWN does not provide warranties or guarantees on plants, trees, shrubs, perennials, annuals, sod, or other living materials.

1.3. Watering & Maintenance

The client is responsible for:

  • Daily and seasonal watering requirements

  • Fertilizing and pruning

  • Summer and winter protection where required

  • Weed control and ongoing garden maintenance

Failure to properly maintain installed materials may result in plant decline or loss

1.4. Site Conditions

OAK&CROWN is not responsible for hidden underground utilities, poor drainage, unsuitable soil conditions, or unforeseen site conditions not visible during the estimate process.

Additional costs resulting from unforeseen conditions may be charged separately upon client approval.

1.5. Payment Terms

Payment is due according to the schedule outlined in the estimate or invoice. Deposits are non-refundable once materials have been ordered or work has commenced.

1.6. Property Damage

While every effort is made to protect existing property, OAK&CROWN is not responsible for:

  • Minor damage to lawns caused by equipment access

  • Settling of soil or mulch after installation

  • Damage or irrigation, utilities, or structures not properly identified by the client

1;7. Design Changes

Any requested changes to the approved design after work has begun may result in additional charges and timeline adjustments

1.8. Weather Delays

Project timelines may be affected by weather conditions, supplier delays, or unforeseen circumstances beyond our control.

1.9. Acceptance of Terms

Approval of the estimate, payment of deposit, or commencement of work constitutes acceptance of these Terms & Conditions.
